Alimony, also known as maintenance or spousal support, is the court-ordered financial support of one spouse by the other spouse, typically as part of a divorce. In some states, this is also known as “maintenance.”
State laws on alimony differ, sometimes substantially. Each state has its own conditions under which alimony may be granted. In some states, property is divided in such a way that the states effectively do away with alimony.
In general, alimony that is granted permanently or for an indefinite period of time may be modified if either former spouse requests it from the court. In many states, the party asking for the modification would have to show a substantial and material change of circumstances for alimony to be modified (for instance, loss of employment or significantly higher income). Alimony that has been granted permanently or for an indefinite period of time typically ends upon death of either spouse or remarriage of the recipient spouse. In some states, alimony may also end if the recipient spouse cohabitates with a significant other (though there are often requirements in addition to mere cohabitation and these vary by state).
